The Czech Supreme Administrative Court confirms the Competition Authority’s decision in a leading agency case (Sazka)

By its decision of 20 November 2008, the Czech Supreme Administrative Court confirmed the decision of the Regional Court of Brno and hence the decisions of the Office for the Protection of Competition by which Sazka, the dominant Czech operator of betting games and lotteries, was found guilty of abusing of its dominant position vis-à-vis its distributors. The alleged abuse consisted in Sazka committing contractually its distributors, organised in an agency network, to sell all lottery tickets from a single pack (usually containing 20 or 50 tickets) by the so-called "pack maturity time", determined as the median of the selling times of such packs in the turnover class to which the agent in question belonged (distributors were categorised into 11 turnover classes).
