The Polish Competition Authority issues updated draft guidelines for setting fines in respect of competition rules violations

This draft was issued pursuant to Articles 81 and 82 of the EC Treaty as well as Articles 6 and 9 of the Polish Act on Competition and Consumer Protection of 16 February 2007 (Journal of Laws of 2007, n° 50, pos. 331 as amended) (hereinafter the “CCP Act”). The draft aims at increasing transparency with regards to the methodology of determining the amount of fines pursuant to the CCP Act. The Guidelines shall allow the undertakings to estimate the amount of the fine related to a given unlawful activity. This being said, the Guidelines are not issued to provide the rules of sentencing, but are established in order to provide some guiding principles on the way to calculate the fine amount.
