The Maltese Commission for Fair Trading sanctions the Government’s temporary exclusive concession of a yacht yard in favour of an undertaking (S & D Yachts)
S & D Yachts Limited, an undertaking acting as agent for yachts mooring in yacht yards in Malta, requested the Director of the Office for Fair Trading (hereinafter referred to as 'the Director), to submit for review to the Commission for Fair Trading (hereinafter referred to as 'the Commission'), in terms of Article 13A of Maltese Competition Act [1] (hereinafter referred to as 'MCA'), her decision of not finding any violation of competition law in an exclusive temporary concession of Manoel Island Yacht Yard (hereinafter referred to as 'MIYY') concluded between the Government of Malta (and Malta Maritime Authority) and MIDI plc (a consortium operating in the estate and maritime business markets).
The impugned decision of the Director followed an investigation triggered by S & D
