The Macedonian Administrative Court quashes two Competition Authority’s decisions having established abusive charges on consumers on the mobile telecommunications market (T-Mobile / Cosmofon / KZK)

On 15 February 2008 Macedonian Competition Authority (Êîìèñè¼àòà çà çàøòèòà íà êîíêóðåíöè¼àòà) (KZK) issued two decisions finding the abuse of dominance on the mobile telecommunications market by two providers : T-Mobile (Ò-Ìîáèëå Ìàêåäîíè¼à) and Cosmofon (Êîñìîôîí Óñëóãè íà ìîáèëíà òåëåôîíè¼à ÀÄ Ñêîï¼å). Both undertakings were found dominant on the market for mobile phone call termination on their own networks. The abuse of dominance allegedly committed by the specified mobile telecom operators consisted in the way they charged the consumers for leaving the voice messages through the voicemail service on their networks. KZK qualified as abuse of dominance the fact the consumers calling T-Mobile's or Cosmofon's customers were charged not from the moment when they started to narrate the voice message but from the moment when the voicemail service was reached.
