The Italian Government adopts legislation aimed at harmonising the tools and powers at the disposal of the competition authorities of the Member States and empowering them to be more effective enforcers

Italy has just enacted the Legislative Decree implementing the ECN Plus Directive so providing the Italian Competition Authority (ICA) with increased enforcement powers. The following sections provide a first overview of the main novelties which include sanctions to natural persons for breach of procedural duties as well as the possibility for the ICA to inspect private houses and premises. Companies will also be subject to higher fines for procedural misbehaviour and can, under certain conditions, directly respond for antitrust violations committed by the association to which they belong.
