The Regional Administrative Court of Lazio confirms that bid-rigging is a competition restriction by object (Eco Trass)

Introduction By a judgment handed down on 16 November 2015 in the case Eco Trass et al v AGCM (Eco Trass) the Regional Administrative Court of Latium (the Court) rejected the appeal against the infringement decision made by the Italian Competition Authority (ICA) in the case I765, Gare Gestioni Fanghi in Lombardia e Piemonte. The Court upheld all the findings in the challenged decision by which the ICA had penalized five firms for bid rigging practices concerning the competitive tender procedures called for by the contracting authorities in the regions of Lombardy and Piedmont for the awards of the contracts for the provision of muds depuration service for the 2008-2013 period. The Court also confirmed the categorization of the contested bid rigging practices as competition
