The Indian Competition Authority orders thorough investigation concerning alleged abuse of dominant position in the market for ’Global System for Mobile Communication’ (Micromax / Ericsson)

In the year 2013, an Indian company, Micromax Informatics Ltd. (hereinafter Micromax), filed a case before the Competition Commission of India (hereinafter CCI) against the Swedish telecoms equipment maker, Telefonaktiebolaget LM Ericsson (hereinafter Ericsson), for alleged abuse of its dominant position in the market for Global System for Mobile Communication telecommunication technology (hereinafter GSM) across India in the licensing of its Standard Essential Patents (hereinafter SEPs). Micromax claimed that Ericsson was demanding “unfair, discriminatory, and exorbitant royalties” to license Ericsson’s SEPs in GSM technology.
