The Romanian Competition Authority sanctions bid rigging practices in the natural gas sector following information received from criminal authorities (Condmag / Inspet / Transgaz)

Introduction The Romanian Competition Council ("RCC") issued in November 2012 a decision ("RCC Decision") pursuant to an investigation concerning alleged bid rigging practices during the tenders organized by Transgaz – the Romanian operator for the transportation of natural gas - and Romgaz – the Romanian operator depositing natural gas ("RCC Investigation"). The RCC Investigation involved a significant number of companies (17 initially) and covered the period 2009 - 2011. The RCC Investigation was subsequently extended to cover also other companies and tenders organized by Romgaz and Transgaz during 2010 - 2011. The RCC Investigation focused on all 11 tenders and all companies investigated although the RCC did not identify evidence to establish anti-competitive practices involving
