The Romanian Competition Authority fines two companies for bid rigging practices in the context of a gas transport pipeline tender procedure (T.M.U.C.B.)

Introduction The Romanian Competition Council ("RCC") published in February 2013 a decision ("RCC Decision") pursuant to an investigation concerning an alleged infringement of art. 5 of Competition Law (mirroring the provisions of art. 101 TFEU) in the context of several public procurement tenders organized in the natural gas sector during 2009-2011 by two State-owned companies ("RCC Investigation"). The RCC decided to open the investigation in September 2011 and it subsequently performed dawn-raids at several companies active in the gas sector. The RCC Investigation involved a significant number of companies i.e. it was initially aimed at 17 companies and it was further extended to 5 additional companies, being as well extended to an alleged infringement of art. 101(1) TFEU.
