The Regional Court in Brno takes a strict view on relevant market definition by the Office for Protection of Competition (Student Agency)

On 9 November 2012, Regional Court in Brno cancelled the decision of Chairman of the Office for Protection of Competition ("Office") in a case concerning an alleged abuse of dominant position in the form of predatory pricing by Student Agency in response to an entry by competing bus company ASIANA on Prague-Brno bus line at the turn of year 2007/2008 and remanded the case back to the Office for further proceedings. The Regional Court found the Office's decision insufficient as regards the relevant market definition. Namely, the court found insufficient the reasoning of the Office as regards separation of bus transport and railway passenger transport into two distinct relevant product markets.
