The Lithuanian Supreme Administrative Court revises a fine for failure to comply with a request for information (UAB Plungės Duona)

On 27 November 2012, the Supreme Administrative Court of Lithuania partially upheld an appeal against a ruling by the Vilnius District Administrative Court concerning a fine imposed on the industrial bakery UAB Plungės Duona for non-compliance with request by the Competition Council ("CC") for information ("RFI"). The Supreme Administrative Court held that both the CC and the Vilnius District Administrative Court applied the law correctly, with the exception of one plea, which led to a minor revision of the initial €25,000 fine. The contested CC decision is the first of its kind and sends a clear signal that the Competition Council's investigations and requests for information are not to be taken lightly.
