I. Introduction Breaching of a seal constitutes a serious violation of the Commission's investigative powers in the competition field for which fines not exceeding 1 % of the undertaking's turnover may be imposed. On 15 April 2008, E.ON Energie brought an action for annulment against a Commission decision in a case of breach of seal and asked in alternative for an appropriate reduction in the amount of the fine imposed. All the claims of this action have been rejected by the General Court. In the present case the appellant asks for the judicial review of the judgment of the General Court, claiming that it should be set aside and that Commission Decision of 30 January 2008 should be annulled.
