The French Council of State concludes that contribution to public electricity service does not constitute integral part of state aid (SNC Stop Hotel Villeneuve D’Ascq)

The company SNC Stop Hotel Villeneuve D'Ascq (Stop Hotel) has asked the French Energy Regulatory Commission ('CRE') to reimburse a part of its tax contribution to the public service for electricity (contribution au service public de l'électricité) ('CSPE'), arguing that it constitutes state aid which should have been notified to the Commission. The CRE rejected the demand and Stop Hotel has appealed the decision to the Council of State ('Council').
