The Turkish Competition Authority prohibits an acquisition as it creates and strengthens a dominant position in the alcoholic beverages market (Burgaz Alcoholic / Mey Alcoholic)

Decision Mey Alcoholic Beverages Industry and Trade Inc. (Mey Alcoholic) made an application seeking a clearance for the acquisition of Burgaz Alcoholic Beverages Commercial and Economic Entity (Burgaz Alcoholic) which was offered for sale by the Turkish Savings Deposit Insurance Fund. The Turkish Competition Authority (TCA) evaluated the situation whether it has a competence in dealing with the acquisition in question. According to Article 5 of the Communiqué on the Procedures and Principles for the Authorization Applications No: 1998/4 [1], in the case the total market shares of the parties in question of acquisition via privatisation transaction exceeds 25% or their total turnover exceeds 25 million Turkish Liras it is mandatory to request the authorisation of the TCA.
