The Italian Competition Authority accepts commitments offered by the incumbent railway undertaking and closes proceeding for abuse of dominance in the rail sector (Rail Traction Company/Rete Ferroviaria italiana-Ferrovie dello stato)

By a recent decision, the Italian Competition Authority (ICA) accepted and made binding a set of commitments proposed by Ferrovie dello stato (FS) and its wholly owned subsidiary Rete Ferroviaria italiana (RFI), the Italian incumbent railway undertaking and the manager of the national rail network respectively, to eliminate the competition problems caused by the refusal to grant the K2 discount to freight train operators. The facts of the case Since 2000 railway undertakings are entitled to the K2 discount on the access charges to rail network as a compensation for higher costs for having to operate two engine-drivers trains because of the technological backwardness of the network. Starting from 2004 RFI discontinue the application of the K2 with regard to the sections of the network
