The Swedish Market Court rejects a complaint against the incumbent for abusive mixed bundling and predatory pricing in the broadband internet access sector (B2 Bredband / TeliaSonera)

Background Bredbandsbolaget sues Teliasonera for abuse of a dominant position on the market for fixed telephony through illegal mixed bundling, customer discrimination and predatory pricing but fails to prove dominance. Decision On 1 November 2005 the Swedish Market Court rendered its decision in the Bredbandsbolaget v. TeliaSonera case. The plaintiff raised very interesting issues of exclusionary abuses of a dominant position but failed to prove that TeliaSonera has a dominant position on any relevant market in Sweden. The Market Court made its analysis on the basis of both Article 82 EC and 19 § of the Swedish Competition Act in parallel. TeliaSonera is the former incumbent operator in Sweden.
