The EU’s foreign subsidies regulation The European Parliament and the Council are currently debating the European Commission’s proposed regulation on foreign subsidies, which covers subsidies granted by third countries that have the potential to distort competition in the EU. In particular, the proposed regulation targets large M&A deals and public procurement procedures involving financial contributions from public authorities outside the EU. Economic tools from the state aid context could help to assess the existence of a foreign subsidy, and its impact on competition.
