The Spanish Supreme Court upholds a judgment of the National Court of Appeal and its assessment of the evidence regarding the definition of the relevant product market (Consenur / Ecotec)

In May, 2015, the Spanish Supreme Court issued judgment number 3974/2012 on the appeals submitted by the Administración General del Estado (General State Administration) against the judgment of the Audiencia Nacional (Spanish Court of Appeal, “AN”) of September 19, 2012. The Supreme Court considers that the AN made a correct assessment of the evidence regarding the definition of the relevant product market. Thus, the Supreme Court confirmed that the relevant market was that of management of dangerous waste in general.
