The Israeli Competition Authority publishes a green paper concerning information exchange during due diligence

Recently the Israeli Antitrust authority published a Green paper concerning information exchange during pre-merger due diligence. Prior to this Green paper the subject of information exchange between competitors during due diligence was not dealt with directly under the Israeli legal system; rather, it was governed by the regular antitrust rules regarding information exchange. The Green paper states that its significance rises due to the fact that there is, on the one hand, great importance to due diligence processes on everyday business conduct and, on the other hand, a constant concern of adverse effect on competition due to information being exchanged during such due diligence. The main concern is that the exchange of information might affect the business conduct of a competitor
