I. The Parties Armajaro Trading Limited (hereinafter “Armajaro”) is active in agricultural products trading (such as coffee, cacao and sugar). Amajaro’s activities include the trading of Liffe Certified Robusta Coffee on the NYSE Liffe Exchange in London (hereinafter “NYSE Liffe Exchange”). Port Real Estate (hereinafter ‘PRE’) operates the Liffe’s storage facilities of Robusta coffee beans in the port of Antwerp, Belgium. II. Facts On November 9th 2011, Armajaro filed a complaint and a request for preliminary measures against PRE before the College of Prosecutors (“Auditorat”) of the Belgian Competition Council.
