A few months after the appointment of its new President (Mr Giovanni Pitruzzella) on 29 November 2011, the Italian Competition Authority (“ICA”) launched a public consultation on new draft guidelines on the commitment procedure [1] which will amend the notice of October 2006 [2] adopted soon after the introduction of the commitment instrument in the Italian legal system (Art. 14 ter of the Italian Antitrust Act - Law 287/90) [3]. The proposed draft guidelines intend to address those aspects of the regulation that have generated doubts in the past years and risked depriving the commitment instrument of its fundamental ratio i.e., to ensure procedural efficiency in cases where the alleged antitrust infringement is not as serious (in terms of social disvalue) as to require the imposition
