In October 2012, the European Court of Justice (“ECJ”) published an order of 3 May 2012, dismissing an appeal by World Wide Tobacco España (“WWTE”) against an earlier EU General Court (“GC”) ruling in the Spanish raw tobacco cartel case. In October 2004, the European Commission had fined WWTE, an indirect subsidiary of the US- based Standard Commercial Corporation, € 1.8 million for its participation in a cartel with other tobacco processors. Four other undertakings were also fined. Among other things, the Commission had found that the participants had fixed the average delivery price for different varieties of raw tobacco and allocated the quantities of each variety of raw tobacco that were to be bought.
