A Swedish Court of first instance renders judgment in a private enforcement case (Gävle harbour)

Introduction Judgment of the Stockholm District Court (the "Court") dated 31 May 2012 in case T 5995-09 regarding Preem Aktiebolag's ("Preem") claim for damages against Gävle Hamn AB (the "Port") for abuse of a dominant position. The Court found that the Port held a dominant position and had applied different prices for similar services without any countervailing economic justification. However, as Preem was not put at a competitive disadvantage, the claim was dismissed and Preem was ordered to pay the Port's litigation costs amounting in total to SEK 3 395 000.
