The Czech Supreme Administrative Court clarifies rules applicable to dawn raids (Bakeries Cartel)

On 29 May 2009, the Supreme Administrative Court rejected cassation appeal of Delta Pekarny (one of the main bakery companies active on the Czech market) against the judgment of the Regional Court in Brno which rejected a claim for judicial review of a decision of the Office for Protection of Competition (“Office”) that imposed fine of CZK 300,000 on Delta Pekarny for impeding investigation of the Office in the course of its on-premises inspection (‘dawn raid') in connection with investigation of price fixing concerted practices between bakery companies on the Czech market.
