The Belgian Competition Council considers an agreement between two transport companies to be compatible with article 2 of the Belgian Competition Law I. The Parties “De Boeck Invest NV” is a holding company. It holds 99,56% of “Autocars Henri De Boeck en reizen André Leloup NV” (“De Boeck”), a Belgian company which provides regular tourist transportation services in the Brussels Region. “Nidco NV” is a management company. It controls “Open Tours-Les Voyages belges NV” (“Open Tours”), a Belgian company organizing coach tours. II. The Facts In 2004, De Boeck Invest and Nidco established a joint subsidiary company called “Brussels City Tour” (“BCT”).
