The Moscow Arbitration Court confirms the Competition Authority’s decision and prescription in relation to operating systems for smartphones (Yandex / Google)

In March 2016, the Moscow Arbitration Court expressed its support of the position of the Federal Antimonopoly Service (FAS Russia) on the case of abuse of dominance by the Google group of companies [1] involving its actions on the Android operation system. The decision of FAS Russia was taken as far back as in Septem-ber 2015, while the company tried to appeal the decision twice, at the Arbitration Court of Moscow in March 2016 and the Ninth Arbitration Court of Appeal in August 2016. Since the last compa-ny’s claim to court was addressing primarily procedural matters, which did not find support among the judges at the end, we concentrate in this article on the points of the Court’s decision of March 15, 2016 as a final one with substantive matters of the case of Google’s practice on
