On 28 March 2013, the Competition Commission of Singapore (the “CCS”) issued its Notice of Decision to approve the proposed alliance between Emirates and Qantas Airways Limited (the “Parties”) (the “Proposed Alliance”), subject to voluntary undertakings. In order to alleviate the competition concerns identified by the CCS, the Parties provided a voluntary undertaking to ensure that the Proposed Alliance would maintain a minimum capacity on the routes where the Parties had existing horizontal overlaps (the “Undertaking”). This is the first notified agreement in respect of which the CCS has accepted voluntary undertakings.
