The Italian Competition Authority fines a dominant undertaking for hindering a public tender procedure for the selection of a new provider of waste management services (Messinambiente / ATO ME3)

By the decision made on 14 March 2012 the Italian Competition Authority (ICA) has fined Messinambiente for abusing its dominant position in the market for waste management services [1]. Messinambiente infringed competition law because it failed to supply a set of data requested by a public authority that organized a public tender procedure for the award of a public service contract previously awarded to the dominant undertaking. The facts of the case The ICA opened an investigation against Messinambiente following a complaint lodged by ATO ME3. ATO ME3, a corporation owned by the Municipality and the Province of Messina, was entrusted with the provision of waste management services. Messinambiente was the incumbent in-house provider for the urban waste
