The Croatian High Administrative Court upholds the NCA’s interpretation of the block exemption regulation on vertical agreements in a resale price maintenance case (M San Grupa)

On 7 March 2012 the Croatian High Administrative Court (VUS) [1] upheld the infringement decision [2] of the Croatian Competition Authority (AZTN) [3] issued against the wholesaler of the household electronics M SAN Grupa d.d.(MSG) for imposing the resale price maintenance obligations on one of its retailers, Rivulus d.o.o.(Rivulus). The case dates back to September 2008 when Rivulus complained to the AZTN about the fact that MSG forced Rivulus to bring its resale prices in line with the list prices provided by MSG. According to Rivulus, MSG has suspended the supply of certain brands of HP laptops until Rivulus agreed to correct its resale prices.
