On March 30th, 2010 the Italian Competition Authority (hereinafter, the ICA) opened a formal investigation into the activities and internal working of the “National Consortium for the recovery and recycling of cellulose-based packaging (hereinafter, the Consortium or COMIECO), members of which (around 3,400 companies) are represented by paper manufacturers (paper mills, sorting plants, and so on), importers of paper and boards for packaging and recycling companies. COMIECO was founded in 1985 as a voluntary association of paper manufacturing companies and became what it is now in 1997 when Legislative Decree n. 22/97, later modified by Legislative Decree n. 152/06, was issued. Both these Decrees reflect two EU Directives, respectively Directive 94/62/EC on packaging and packaging
