The Bosnian & Herzegovinan Competition Authority issues its new leniency guidelines

On 23 March 2010 the Competition Authority of Bosnia & Herzegovina (KV) [1] adopted its new 2010 Leniency Guidelines [2] that replaced 2006 Leniency Guidelines [3] with effect from May 2010. This note summarizes the changes introduced by the 2010 Guidelines and highlights the remaining problems in the application of the leniency program in B&H. The 2006 Guidelines provided for immunity from fines for an undertaking that supplies to the KV necessary evidence that would allow the latter to initiate an infringement procedure [4]. The 2010 Guidelines further explained that the immunity from fines shall be granted under condition that at the moment of the application the KV did not
