Summary The Romanian Competition Authority granted an individual exemption under Article 5(1) of the Competition Law n° 21/1996 [1], a provision equivalent to Article 81(3) EC for a series of exclusive distribution contracts concluded between leading sugar products manufacturer SC Cadbury Romania SA and its distributors. The competition authority took into account the levels of concentration on the relevant market, low barriers to entry and the fact that the specified agreements did not contain any hard core restrictions.
