The Hungarian Parliament adopts an amendment limiting the liability of leniency applicants and introducing new calculation of amount of damages

This article was prepared for the UIA-AIJA seminar "Antitrust and Unfair Competition Developments Forum", held in Brussels on April 24-25, 2009. (More information: on www.uianet.org and www.aija.org websites). On March 23, 2009, the Hungarian Parliament adopted an amendment to the Competition Act [1]. The amendment provides for express rules harmonizing the leniency program and civil actions for damages in the course of private enforcement. The new rules constitute significant alternative to the White Paper [2]of the Commission. Further, the amendment introduces a presumption for the calculation of the amount of damages caused by cartels (presumption on a 10% overcharge).
