An overview of the proposed new Swedish Competition Act (Prop. 2007/08:135 Ny konkurrenslag)

On 27 March 2008, the Swedish Government submitted a proposal [1] for a new Swedish Competition Act (the «Proposed Competition Act») to the Swedish parliament (sw: riksdagen). The proposed act is suggested to come into effect on the 1 November 2008. The current Swedish Competition Act (SFS 1993:20, hereinafter the «Competition Act») entered into force in connection with Sweden's association to the EEA in 1994, and has since then been subject to a number of amendments in connection with changes of the EC competition rules [2]. The Proposed Competition Act, provided that it is adopted, will most likely result in a more efficient administration for competition infringements and will clarify the application of the Swedish competition rules.
