A German Court holds lawful ban of sales through online auction platforms by retailer (School bags manufacturer)

Summary On 13 March 2008 the regional court of Mannheim (Landgericht Mannheim) decided that a manufacturer ("the manufacturer") of school bags does not violate German Competition Law ("GWB") by stopping to supply a retailer ("the retailer") that did not comply with the manufacturer's conditions when selling its school bags. The retailer had sold the manufacturer's school bags through an internet auction platform. The manufacturer's conditions explicitly rule out such sales. In response the manufacturer stopped supplying the retailer with its products. Background The law suit was initiated by the retailer who sells the manufacturer's high quality school bags, rucksacks and other products through a dedicated retail store, a dedicated online shop and an internet auction platform.
