The Polish Competition Authority confirms that the entity in charge of the management of the general compulsory health insurance system is an entrepreneur and therefore is subject to competition law (Narodowy Fundusz Zdrowia)

On March 7th, 2007 the President of the Office for Competition and Consumer Protection (hereafter the OCCP President) found that Narodowy Fundusz Zdrowia (National Health Fund, hereafter, NFZ) violated the dominant position abuse prohibition, contained in Article 8 paragraph 1 in conjunction with article 8 paragraph 2 (1) of the Act of 15 December 2000 on Competition and Consumer Protection (hereafter ACCP), by direct imposition of unfairly low prices while contracting dental services for the year 2004. However, before commenting this case, a short description of the Polish general compulsory health insurance system would be helpful for a better understanding of the case.
