The Czech Competition Authority confirms abuse of dominant position by the energy incumbent (RWE Transgas)

On 13 March 2007, the second instance decision of the Czech Office for Protection of Competition (the “Office”) was rendered by the Chairman of the Office (the “Chairman”) in the case of RWE Transgas a.s. (“RWE Transgas”, or the “company”), after the company appeal against the first instance decision. Brief overview of the market RWE Transgas is a dominant Czech wholesale natural gas supplier by virtue of a supply contract for 9 billion m³ of natural gas concluded with Gazprom Export Ltd, effective until 2035. The company came to existence after Transgas, a.s., formerly a state-owned company, became part of the RWE Group in May 2002 when the Office approved its merger with RWE Gas A.G.. The gas is transported into the Czech Republic by a transport grid operated by one of the RWE holding
