The Romanian Supreme Court overturns the Competition’s Authority decision having fined one participant to a cartel for lack of sufficient proofs (Cement cartel)

Competition Council (Consiliul Concurentei), 26 May 2005, Decision n° 94 relating to the sanctioning of Lafarge Romcim SA, Holcim Romania SA and Carpatcement Holding SA for the infringement of Article 5(1) (a) of the Competition Law n° 21/1996. By its Decision n° 1358 of 5 March 2007, the Romanian High Court of Cassation and Justice (the “High Court”) overturns the Decision n° 94/2005 of the Competition Council (the “NCA”) in respect to one party to which the NCA Decision has previously applied - Carpatcement Holding S.A (“Carpatcement”). The judgment of the High Court cancels the totality of the fine which has been imposed, back in May 2005, upon Carpatcement. The judgment does not refer to any of the other two parties which have been fined for cartel activity by the same NCA Decision
