The Polish Competition Authority holds that the National Health Fund has imposed its dominant position by imposing low purchase prices of health services (Narodowy Fundusz Zdrowia)

In his decision dated 7 March 2007, the President of the Office for Competition and Consumer Protection (“the President of the OCCP”) recognized that the National Health Fund (“the NHF”) abused its dominant position on the national market for organizing dentistry services as part of the national insurance system under the NHF, through direct imposition of unfair, i.e. strikingly low purchase prices of health services in the process of contracting services for the year 2004. The proceedings were instituted at the request of the Regional Medical Chamber (Okr?gowa Izba Lekarska) in Kraków (“the RMC”).
