The Spanish Competition Court of Appeal revokes the Competition Authority’s decision on an abuse of dominance due to the absence of anticompetitive effects on the market regarding access to liquid natural gas importing infrastructures (Gas natural)

The Antitrust Court Decision In June 2006 the Tribunal de Defensa de la Competencia, the former antitrust court in Spain, hereafter TDC, [1] imposed an 8 million euro fine to Gas Natural, the main natural gas operator in Spain, on the basis of an abuse of dominant position regarding access to liquid natural gas (LNG) importing infrastructures in Spain. [2] The TDC considered that Gas Natural abused its dominant position in the access to LNG regasification plants capacity by means of a long term contract with Enagas, the main natural gas transporting company in Spain and owned at the time by Gas Natural.
