On 22 June 2021, the heads of the national competition authorities (“NCAs”) published a joint position paper entitled How national competition authorities can strengthen the DMA (“NCA Paper”). The NCA Paper argues that NCAs are well placed to assist the European Commission (“Commission”) – and specifically, as the NCA Paper suggests, the Directorate-General for Competition (“DG COMP”) – with the enforcement of the Digital Markets Act (“DMA”). As the DMA is going through the legislative process and is currently under review by the European Parliament, there is a clear risk that its enforcement could end up centralised in the hands of the Commission.
