The Spanish Government publishes a decree which greatly amends national competition law as a result of the transposition of the ECN+ Directive

On 28 April 2021, Royal Decree-Law 7/2021, of 27 April, was published in Spain's Official State Journal (RD 7/2021). RD 7/2021 has the aim of transposing into Spanish legislation a number of EU directives, including Directive (EU) 2019/1 of the European Parliament and of the Council of 11 December 2018 (Directive 2019/1) to empower the competition authorities of the Member States to be more effective enforcers and to ensure the proper functioning of the internal market (ECN+ Directive). The deadline for transposing the ECN+ Directive was 4 February 2021 and the European Commission has opened proceedings as a result of the breach. Although most provisions of the ECN+ Directive had already been provided for in Spanish legislation, the Directive contains a number of innovative elements
