In June 2018, the Luxembourg Competition Council published a decision regarding a cooperation between competitors involving price fixing, one of the most manifest and serious restrictions of competition. In the decision “Webtaxi”, the Competition Council found that a taxi reservation centre which set the prices that taxis belonging to several taxi companies would charge passengers was exempted from the application of Article 3 of the Luxembourg Law on Competition, the national equivalent of Article 101 TFEU. This is the first ever decision taken by the Luxembourg Competition Council exempting a prima facie anticompetitive agreement or practice and is therefore significant for competition law enforcement in the country.
