Section 5 of the FTC Act  gives the Commission authority to challenge “unfair methods of competition” (UMC). In June 2013, Commissioner Joshua Wright of the FTC released a proposed policy statement on the Commission's UMC authority.  His statement is intended to create guidance for enforcement within a structured, analytical framework. The Commission issued policy statements on its Section 5 Unfairness and Deception Authorities decades ago. But both were issued under pressure from Congress after the FTC over-extended its authority in a series of rulemakings in the 1970s. UMC is the last major Section 5 power that remains largely undefined.
