The Hellenic Competition Authority imposes on a Greek leading movie producer and distributor the obligation to supply movies to its economically dependent competitor (Odeon / Technopolis)

Facts In 2005 the company "ODEON ENTERPRISE OF PUBLIC ENTERTAINMENT S.A.", hereinafter ODEON, opened the multiplex cinemas ODEON TALOS in Heraklion of Crete, in Greece. In the same area another multiplex called TECHNOPOLIS CINE TSAGKARAKIS S.A., hereinafter TECHNOPOLIS, has been active since 1986. TECHNOPOLIS is active in the sector of entertainment and more specifically in the management and operation of cinemas in Heraklion. ODEON is active both in the markets of film distribution and operation of cinemas, either by signing licensing contracts with cinemas' owners or by providing to them rights such as trademark and technology transfer in order to manage the cinemas themselves. Thus there are two product markets at stake: a) the film distribution in which TECHNOPOLIS is a customer
