The EU General Court dismisses appeals in a fasteners cartel (Berning & Söhne / Coats)

On 27 June 2012, the General Court (“GC”) handed down its judgments on appeals brought by Berning & Söhne, Coats Holdings (“Coats”), and YKK against a Commission decision fining them for operating a series of cartels in the markets for zip and other fasteners and their attaching machines. The GC upheld the fines and ruled that all three appeals should be dismissed in their entirety. In the September 2007 decision under appeal, the Commission had imposed fines totalling € 328 million on seven groups of haberdashery makers, among which the three appellants, for their participation in the fasteners cartel.
