In two cases decided in 2012, the Competition Commission of India (CCI) found evidence of collusion amongst wholesale and retail distributors of pharmaceuticals in particular regions of India. We analyze one case (Varca Chemist and Druggist and others vs Chemists and Druggists Association, Goa) in detail [1]. Although it concerns the small state of Goa, it throws light on what appears to be a range of common practices affecting the pharmaceuticals supply chain all over the country, involving producers as well as distributors. The facts The case was originally filed in June 2009 under India’s old competition law, the Monopolies and Restrictive Practices (MRTP) Act, shortly before it was repealed in order to make way for the Competition Act [2].
