A Dutch District Court reduces the amount of fines for breach of the seal during ongoing competition investigations (LHV)

Introduction The national society of general practitioners (Landelijke Huisartsen Vereniging, hereinafter “LHV”) was fined by the Dutch Authority for Consumers and Markets (hereinafter “ACM”) for a breach of a seal during ongoing competition investigations. In this case the District Court Rotterdam ruled on the liability of the LHV for the breach of the seal and examined mitigating factors for a reduction of the fine.
