The Russian Constitutional Court confirms the constitutionality of certain provision of the Competition Law regulating the powers of the national competition authority (Gazenergoset / Nizhnekamskneftkhim)

In 2006 two companies, applicants in the present case, OAO “Gazenergoset” [1] and OAO “Nizhnekamskneftkhim” [2] have been found in violation of the competition law. Russian Competition Authority (Федеральная Антимонопольная Служба) (FAS) [3] found that undertakings concerned participated in the concerted practices and anticompetitive agreements aimed at fixing the prices on the relevant product markets and their maintenance at the monopolistic levels. Each of the companies was ordered to stop ongoing violations and transfer the illegally obtained revenues to the state budget. Gazenergoset and Nizhnekamskneftkhim appealed the FAS's decisions before various arbitration courts. As the judicial institutions have affirmed the legality of the FAS's decisions and
