The Polish Competition Authority imposes a financial penalty on a collective copyright management association for practices restricting competition (SAWP)

Introduction Polish competition authority questions the practices of the Polish Musical Performing Artists' Association (SAWP - Stowarzyszenie Artystów Wykonawców Utworów Muzycznych i Słowno-Muzycznych). In the decision from June 10, 2009, the President of the Office of Competition and Consumer Protection (“the OCCP President”) found two practices of SAWP inconsistent with the provisions of the competition law. It should be noted that it is not the first OCCP President's decision in relation to an association of collective management of copyright and related rights. As an example of previous decisions one could name decisions against ZAIKS (Authors' Association), against the Union of Polish Art Photographers ZPAF and the Union of Polish Performing Artists' Association STOART.
